Do You Need A Workers' Compensation Medicare Set-aside?

Does the claimant have a "reasonable expectation" of becoming a Medicare Beneficiary within the next 30 months?

A reasonable expectation includes the following:

  • 62.5 years of age or older;

  • currently receiving Social Security Disability benefits;

  • has applied for Social Security Disability benefits;

  • is appealing the denial of Social Security Disability benefits; or

  • has End Stage Renal Disease.
