CMS Releases 2020 Recovery Thresholds for Non-Group Health Plan Cases


CMS recently issued notice of the “2020 Recovery Thresholds for Certain Liability Insurance, No-Fault Insurance, and Workers’ Compensation Settlements, Judgments, Awards or Other Payments.” According to the release, the threshold of physical trauma-based liability insurance settlements will remain at $750. CMS will also maintain the $750 threshold for no-fault insurance and workers’ compensation settlements in cases where the no-fault insurer or workers’ compensation entity does not otherwise have ongoing responsibility for medicals (ORM). Accordingly, entities are not required to report, and CMS will not seek recovery, on workers’ compensation, no-fault, or physical-based liability settlements that do not meet the $750 threshold and where ORM does not otherwise exist.
