CMS Processes and COVID-19 Emergency


We have been informed by CMS that they are continuing normal operations as much as possible during the COVID-19 emergency. Unfortunately, CMS has indicated that they are still holding RREs to the regular 30 day deadline for Conditional Payment Notice disputes and 120 day deadline for formal demand appeals, even if the RRE’s processing of correspondence from CMS has been interrupted. If you are experiencing issues with processing and responding to correspondence from CMS, please let us know. Parties with delays in issuing checks may prefer to submit payment online to CMS through the Medicare Secondary Payer Recovery Portal. CMS will accept payments online from authorized users of the portal. CMS does not appear to have slowed much in reviewing MSAs. We have continued to receive determinations in many cases in less than 4 weeks. We will let you know if anything changes with CMS.
