CRC Contractor to Start Seeking Recovery for Medicare Advantage Plan Liens

The current Commercial Repayment Center (CRC) contractor, Performant Financial Corporation, recently announced that they will be pursuing recovery for Medicare Advantage Plan liens in addition to conditional payment claims. Performant stated that they have contracts in place with Medicare Advantage Plans that cover more than four million Medicare beneficiaries. Performant’s expansion into the Medicare Advantage Plan recovery process is separate from their role as the CRC contractor, and their conditional payment claim correspondence will be separate from Medicare Advantage Plan correspondence.


Parties should be certain to look out for correspondence from Medicare Advantage Plans and their recovery contractors. Given how aggressive Performant has been in seeking recovery as the CRC contractor, we can expect Performant to aggressively pursue recovery for Medicare Advantage Plan liens.


As a reminder, the PAID Act was passed at the end of 2020 and provides that Medicare must provide information in query responses about any Medicare Advantage Plans and Medicare Prescription Drug Plans in which a beneficiary has been enrolled for the last three years. We are awaiting the implementation of this process, which is supposed to occur this year.
