PAID Act Signed into Law by President

On December 11, 2020, President Trump signed the Provide Accurate Information Directly (PAID) Act into law. This is a significant, very positive development for all liability and workers’ compensation claims involving Medicare beneficiaries. The requirements of this Act must be implemented by CMS within one year. Specifically, the Act requires that the identity and address of Medicare Advantage Plans and Prescription Drug Plans in which a claimant has been enrolled over the past three years be provided during the Section 111 query process. This will greatly assist primary payers with researching and resolving any conditional payment claims/liens that exist. Currently, the process to identify such plans to resolve liens is very difficult and time-consuming, so this Act is a welcome development.
